Mumbai Drug Dealer Walks on Technicality
Rather than face 10 years in jail, Pramod Kumar Saroj is free today after his defense found a technicality which made his arrest unlawful. Saroj, who was caught trying to sell 1100 grams of marijuana in Mumbai in February 2004, is free because the non-police witness in his trial failed to note that Saroj had been read his rights by a “magistrate” or “gazetted officer,” as required by Section 50 of Narcotics Drugs and Substances law. The witness, who was from Tamil Nadu and spoke broken Hindi at best, said only “higher officer” which was unacceptable, and Saroj was able to walk free when police couldn’t find another witness.
